Terms and conditions.

Definitions
“Sendean”: The camera repair company. “The Customer”: The person, firm or company for whom repairs are undertaken. “The Goods”: The goods presented for repair.
1. Work To Be Done
1.1 Sendean shall have the sole discretion to decide the nature, extent and method of repairs and the type of replacement parts to be used. No liability is accepted for replacement parts as set out in these conditions.
1.2 Sendean may sub-contract all or part of repairs at its sole discretion and without prior notification to the Customer.
2.Delivery Dates
2.1 All dates given by Sendean for completion of repairs are estimated only and Sendean shall not be liable for any loss/compensation resulting from failure to meet such dates. Failure to meet such dates shall not entitle the Customer to cancel the order.
3.Estimates
3.1 Where an estimate for the price of repairs is given by Sendean it shall not be obliged to commence work until an acceptance and payment is received from the Customer. Sendean may at any stage submit a further or revised estimate.
3.2 When Sendean supply a revised estimate and this is not accepted by the Customer, Sendean reserve the right to make a charge for handling and examination, usually £25. No liability can be accepted by Sendean for the re-assembly of equipment dismantled for the purpose of examination.
3.3 Sendean shall provide a full refund on repairs in the unlikely event that repairs are unable to be completed only when it does not conflict with section 3.2. This does not include failure to meet a deadline.
3.4 If goods are returned at a later date to Sendean for repair Sendean shall be under no obligation to complete repairs for the cost previously estimated or to refund charges made for the estimate declined or not accepted.
3.5 If an estimate is not accepted within 90 days from the date of estimate, Sendean shall be entitled to dispose of the goods or charge a storage fee of £30+VAT.
3.6 Once work has been proceeded by the Customer they are agreeing to the Terms and Conditions. If work has been proceeded and subsequently cancelled this will be subject to a penalty fee to be determined by the technician. This is not the case for the majority of requoted work or when there are exceptional circumstances. The decision to charge is made by the Sendean technician and is non negotiable.
3.7 Sendean provide written estimates for £10 per item. Estimates are subject to revision in the event that further damage is revealed in the process of a repair.
 3.8 Sendean may record phone calls for proof of business transactions.
4.Payment and Despatch of Goods
4.1 Payment in full is required before any repairs commence or before any parts to be ordered.
4.2 Unless Sendean has agreed to open a credit account for the Customer no Goods will be dispatched except on receipt of payment.
4.3 All sums due to Sendean by the Customer by way of credit account shall be paid within 30 days of the invoice. Failure to settle the account within 30 days of the invoice shall entitle Sendean to cease work on all Goods received from the Customer pending statement.
4.4 If the Customer shall fail to pay all sums due for repair of the Goods within 3 months of the date of completion Sendean may forthwith sell any or all Goods at such a price as in its discretion sees fit and may retain from the proceeds of such sale any amount sufficient to defray costs of repairs and expenses incurred in attempting to trace the Customer. No interest shall be payable on any balance retained by Sendean.
4.5 Sendean shall charge a storage fee for uncollected paid goods after 90 days of the repair completion. This charge is £5 per subsequent week payable in full upon collection. No goods will be released without the appropriate charges paid to Sendean.
 
5. Company’s Liability
5.1 Sendean shall be responsible for Goods from the Customer until the Goods are delivered back to the Customer. All Goods delivered by Sendean shall be insured at the current secondhand value.
5.2 Sendean shall not be responsible in respect of any consequential loss or damage whatsoever claimed by reason of repairs carried out, nor any damage, injury or loss aring from the use of the Goods. No claims whatsoever will be entertained for loss or damage to photographic or video materials, tubes, batteries or lamps nor will Sendean be responsible for parts or assemblies requiring replacement being sent to suppliers by way of sample or replacement.
5.3 Sendean shall not be responsible for any accessories left by the Customer accompanying the Goods. Any accessories are left at the Customers risk i.e film, tape, filter, cap, strap, card, batteries, charger.
6. Customer’s Liability
6.1 The Customer warrants that the Goods are not dangerous or potentially dangerous and shall indemnify Sendean against any loss or damage caused by the breach hereof.
6.2 If the Customer is not the owner of the Goods the Customer shall at all times be deemed to be acting as the agent of the owner and not the agent of Sendean.
7. Guarantee
7.1 Goods are accepted by the Customer on the condition that their value does not exceed the current secondhand value of such equipment.
7.2 Sendean guarantees repairs against defects in workmanship, or defects in parts or replacements supplied for the following periods: If the equipment is repaired/serviced in accordance with our estimate the whole item is guaranteed for 3 months. If a partial repair is carried out the part repaired only is guaranteed. Guarantees are only valid with the original invoice of the specific repair/purchase.
7.3 The guarantee period starts from the date the Customer collects.
The Guarantee Shall Extend to
7.2a Any removable module or sub assembly fitted to the equipment – for example removable lenses, meters, film backs or cartridges if such items have been repaired.
The Guarantee Shall not Extend to
7.2b No proof of receipt. Without the original invoice given at the time of collection, Sendean will not honour a guarantee either for a purchase or repair.
7.2c A late collection of goods. It is the responsibility of the Customer to collect equipment as soon as the repair is completed to benefit fully from the guarantee period. Non collection will not extend the guarantee period.
7.2d Damage or deterioration caused through transportation or negligence of any party other than Sendean, misuse accident, or any attempted repair by any party other than Sendean.
7.2e Motors, meters, tubes, valves, transistors, lamps and batteries save where such parts have been fitted by Sendean and replacement is available under guarantee from the suppliers of such items.
7.2f Repairs made without charge whether a guarantee is stated or not.
7.2g Any claim under this guarantee can only be considered if received by Sendean in writing within the stated guarantee period, and the Goods properly packaged together with a list of alleged defects are sent at the Customers expense to Sendean. Sendean’s decision as to the extent of its obligation thereunder shall be final. IT IS THE RESPONSILBILITY OF THE CUSTOMER TO SEE THAT GOODS ARE TESTED WITHIN THE PERIOD OF THE GUARANTEE. NON USE OF THE EQUIPMENT DOES NOT EXTEND THE PERIOD OF THE GUARANTEE.
7.2h Sendean shall not extend the guarantee on any purchase/repair if a repair is carried out under guarantee.
7.2i Sendean shall on no account be liable for any charges made by another party for repairing the Goods save where such repairs are expressly authorised by Sendean in writing.
7.2j Sendean may at any time fulfill its entire obligations under this guarantee by returning the Goods to the Customer and refunding the repair charge paid.
8. Process Paid Vouchers
8.1 Multiple boxes crossed deem the Sendean process paid voucher for movie camera film void. The Customer cannot change/transfer/return any voucher. Sendean cannot replace lost vouchers without a further charge of another voucher in full. Any tampered vouchers will be deemed void and a charge will be issued. It is the Customer's responsibility to ensure the information is correctly completed. Only a member of Sendean staff can complete the front form. It is upto the Customer to fill out the back with their details.
8.2 Damaged/torn vouchers may be replaced under the discretion of Sendean. Non use of the voucher does not entitle the Customer to a refund.
8.3 Sendean shall on no account be liable for any postal or other third party company charges, delays or losses to the Customer. It is the responsibility of the Customer to resolve any dispute with the third party company involved.
8.4 Sendean reserve the right to withdraw production of the vouchers at any time. This does not affect the Customer's statutory rights.
9. Equipment Hire
9.1 The full amount of goods is to be paid prior to release of equipment from Sendean as the deposit. Once the equipment has left premises of Sendean the Customer is liable for the equipment hired. Any damage/user error/theft is the responsibilty of the Customer and will result in part or full deposit being revoked.
9.2 Hire charges are on a daily rate depending on equipment and are refunded from the deposit taken. Failure to meet the deadlines will result in further charges at the standard rate per day up to a maximum value of the goods.
9.3 Sendean shall not be responsible for any material lost during use of equipment or third party equipment.
10. Discount Vouchers
10.1 Vouchers can only be used at the Hatton Garden branch of Sendean for use against repairs or used equipment (excludes film stock, vouchers, credit notes and miscellaneous accessories) before their expiry date as stated on the voucher. When used against a repair, vouchers shall only be accepted if presented when equipment is booked in. Expired vouchers will not be accepted.
10.2 Damaged/torn vouchers may be replaced under the discretion of Sendean. Non-use of the voucher does not entitle the Customer to an extension or cash value (equiv. 0.0001p).
10.3 Sendean reserve the right to withdraw production of the vouchers at any time. This does not affect the Customer's statutory rights.
11. Variation
11.1 These conditions shall not be varied by the Customer. Any order conditions specified by the Customer contravening any conditions specified by Sendean shall be void.
11.2 Sendean have the right to amend/alter their terms and conditions without prior notification of the Customer.
12. Law
12.1 These conditions and any agreement between the Customer and Sendean shall be governed by English Law.
